1. About these Terms

1.1. EXEcutor32 (the "App") is provided by Leonid Gorbarenko, the developer and seller of EXEcutor32 on the App Store ("we", "us"). Email: executor32.app@gmail.com.

1.2. Your licence to use the App is Apple's Licensed Application End User License Agreement (the "Standard EULA"): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms add to the Standard EULA. If the two differ, the one that is more favourable to you applies. This rule does not apply to governing law: section 9 decides it.

1.3. Our Privacy Policy (https://executor32.com/privacy-policy) explains how personal data is handled.

1.4. These Terms are written in English. A translation is for convenience; if it differs from the English text, the version more favourable to you applies.

1.5. You must be at least 18 years old to use the App.

2. What the App does

The App runs 32-bit PC programs that you supply. It does not include any games, programs or other third-party content, and we do not host such content.

3. No guarantee of compatibility

3.1. We do not guarantee that any program will install, start, run or perform well in the App. Results depend on your device, the iOS or iPadOS version, and the edition, version and settings of the program. Graphical and audio artifacts, slowdowns, crashes and missing features are possible, and a program that worked before may work differently after an update.

3.2. Any compatibility list, game profile or recommended setting that we publish shows only the results of our own tests. It is information, not a promise.

3.3. Please try a program in the free mode (section 7.1) before you buy.

4. Your content and third-party websites

4.1. The programs and files you add to the App, and your rights in them, are yours. You are responsible for them. Use only content that you are legally allowed to use, and follow its licence terms and the law, including the rules on copy protection.

4.2. Websites you open and files you download in the built-in browser belong to third parties. We do not own, run, check or endorse them.

5. Acceptable use and multiplayer

5.1. Do not use the App, including its multiplayer features and built-in browser, to:

  • run, share or download programs or other content that you have no right to use, such as pirated or cracked copies;
  • spread malware or any program meant to damage devices or data or to get unauthorised access to them;
  • attack, overload or get unauthorised access to other people's devices, networks or online services;
  • harass, threaten or deceive other players, or send them unlawful content;
  • break the law or infringe the rights of others.

5.2. Multiplayer is a beta feature. It may work only with some programs, and it may change or be removed. Rooms connect devices directly (nearby play) or through Apple's Game Center, which Apple runs under its own terms. We do not run multiplayer servers, and we do not see or moderate what players send each other. Play only with people you trust, and host only programs that you and the other players are allowed to use. You are responsible for what you share in a room.

6. Back up your files

We do not back up your files and cannot recover them. Files in the App or in folders you link to it can be lost or damaged, for example by a program, an update or the removal of the App. Keep your own copies of anything important, especially saves.

7. Free mode, plans and purchases

7.1. Free mode. Without a paid plan you can use the App for free, but each program session is limited to 5 minutes. The purchase screen shows the current conditions of the free mode. We may change them; a change does not affect a plan you have already paid for.

7.2. Plans. EXEcutor32 Pro is an auto-renewing subscription that removes the free mode's time limit. The plans, their prices and what they include are described on the App's purchase screen and on the App Store before you buy. A plan may start with a free trial (currently 1 week) if Apple finds you eligible. Unless you cancel at least 24 hours before the trial or a subscription period ends, the subscription renews and Apple charges you.

7.3. Apple processes all purchases and payments. You manage and cancel subscriptions in your Apple Account settings. Refunds are made by Apple under its terms, for example at https://reportaproblem.apple.com. If you have a problem with a purchase, write to us and we will help.

8. Warranty and liability

8.1. To the extent the law allows, the App is provided "as is" and "as available". We do not promise that it will be free of errors or interruptions, or that it will run any particular program (section 3).

8.2. Nothing in these Terms or in the Standard EULA excludes or limits liability that cannot be excluded or limited under the law that applies to you, including liability for intent or gross negligence, for death or personal injury caused by negligence, and your statutory rights as a consumer.

8.3. Subject to section 8.2, the further warranty disclaimers and limits of liability in the Standard EULA apply to us as the App's licensor.

9. Governing law

9.1. These Terms, and the Standard EULA as it applies between you and us, are governed by the laws of Georgia, excluding its conflict-of-law rules. To the extent the law allows, this section takes the place of the governing-law clause of the Standard EULA in matters between you and us. It does not affect Apple's own rights under the Standard EULA.

9.2. If you use the App as a consumer, you keep the protection of the mandatory laws of the country where you usually live, and you may also bring a claim in the courts of that country.

10. Ending your use

10.1. You can stop using the App at any time by deleting it. Deleting the App does not cancel a subscription; cancel it in your Apple Account settings.

10.2. Your right to use the App ends if you seriously or repeatedly break these Terms (in particular section 5) or the Standard EULA. You must then stop using the App and delete it.

10.3. We may stop offering the App or a feature, or stop updating it. Where we can, we will tell you in advance in the App or on our website. If this happens during a subscription period you have paid for, you can ask Apple for a refund of the unused part, and we will support your request.

10.4. Sections 4, 6, 8, 9 and 12 continue to apply after your use ends.

11. Changes

We may update these Terms, for example when the law, Apple's rules or the App changes. We will publish the new version at https://executor32.com/terms and change the "Last updated" date at the top. We will tell you about material changes in advance, in the App or on our website. If you do not agree, you can stop using the App and cancel your subscription. A change does not take away rights for a period you have already paid for.

12. General

12.1. If a court finds any part of these Terms invalid or unenforceable, the rest stays in force, and that part applies to the greatest extent the law allows.

12.2. If we do not enforce a provision straight away, we do not give up the right to enforce it later.

12.3. These Terms, the Standard EULA and the plan details shown before you buy (section 7.2) are the whole agreement between you and us about the App. Our Privacy Policy explains how we handle personal data.
